Criminal Charges for Driving on a Suspended or Revoked License: Obviously, you should not drive while your license is suspended or revoked. If you do and get caught, you may be charged with a Summary Offense, or in some circumstances a more serious crime.
Penalties for alcohol related suspensions: If your license was suspended or revoked due to an alcohol or drug induced offense such as a DUI, you may be charged with a Summary Offense. 75 Pa.C.S. 1543(b)(1). Your sentence may result in the following: • $500 fine, and • imprisonment for between 60 and 90 days. 75 Pa.C.S. 1543(b)(1).
If your license was suspended for an alcohol/drug offense DUI, and you have a certain amount of alcohol/drug in your system when you are pulled over for driving after a suspension or revocation, you sentence may be the following: • $1,000 fine and • imprisonment for at least 90 days. 75 Pa.C.S 1543(b)(1.1)(i)
For a second offense in this situation, you may be charged with a Third-Degree Misdemeanor. 75 Pa.C.S. 1543(b)(1.1)(ii). You sentence may include the following: • $2,500 fine, and • imprisonment for at least 6 months.
For a third offense in this situation, you may be charged with a First Degree Misdemeanor. 1543(b)(1.1)(iii). You may be sentenced to: • $5,000 fine, and • imprisonment for at least 2 years.
Additional Penalties: In addition, if you are convicted of driving after suspension or revocation your license will be suspended for a further period of time. 75 Pa.C.S. 1543(c). In certain situations, your vehicle may be impounded. 75 Pa.C.S. 6309.1(b).
