Requirements for breathalyzer test reliability

Breathalyzer test reliability and accuracy is an important topic for drivers who have been accused of driving under the influence and are facing DUI charges following a breathalyzer test. It may be possible to challenge a breathalyzer test that does not meet requirements for accuracy.

Breathalyzer tests may oftentimes lead to DUI charges. Though breathalyzer test requirements can vary by test, there are some general requirements. To meet standards for reliability and accuracy, breathalyzer tests must be routinely maintained and calibrated. To help ensure reliability, the breathalyzer test used should be on a conforming list of acceptable devices and the breathalyzer test must be properly maintained so that it is checked for accuracy and regular and set intervals.

In addition, breathalyzer tests must be properly administered to ensure the accuracy of the test results they provide. The police officer administering the breathalyzer test must receive appropriate training in the use of that breathalyzer test device; the police officer must administer the breathalyzer test according to the training they have received; and the police officer must ensure the accused driver’s bodily fluids do not interfere with the breathalyzer test results.

An additional requirement for breathalyzer test reliability is that the breathalyzer test must also capture at lease two measurable readings that are within .02 of one another. If any of these requirements for breathalyzer test accuracy and reliability are not met, it may be possible to challenge the results of the test and the charges the accused driver is facing. As a result, it is crucial for accused drivers to be familiar with breathalyzer test requirements.
